If a person considers that his or her right of access to information of public interest has been violated, he or she may submit an administrative complaint to the head of the public authority or institution from which the information has been requested, in accordance with the provisions of Art. (2) of Law no. 544/2001 on free access to information of public interest, with subsequent amendments and additions, as well as Articles 32-34 of Government Decision no. 123/2002 approving the Methodological Norms for the application of Law no. 544/2001 on free access to information of public interest. Models of administrative complaints can be found in Annexes 2 a) and 2 b) of the Methodological Norms.
Also, if the applicant considers that his rights under the law have been violated, he may lodge a complaint with the administrative division of the court within the territorial radius of which he resides or within the territorial radius of which the public institution or authority is located, as provided for in Art. (1) of the Law no. 544/2001, with subsequent amendments and additions, and art. 36 of the H.G. no. 123/2002.
